Terms of Service

These Terms of Service ("Terms") govern your access to and use of lemonpeak.com and the services provided by Lemonpeak Marketing Services Pvt Ltd ("Lemon Peak," "we," "us," or "our"), including our marketing/paid media services and software products (CitrusIQ, KratosID, and CallSync AI) (collectively, the "Services"). By accessing our website or using our Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use our Services on behalf of yourself or an organization you represent.

2. Description of Services

Lemon Peak provides:

• Marketing & paid media services — campaign strategy, ad management, and performance marketing for clients
• CitrusIQ — conversation intelligence and analytics for sales and support teams
• KratosID — identity and managed security services
• CallSync AI — an AI-powered voice agent that converses with and qualifies inbound leads on behalf of clients

Specific service scope, deliverables, and pricing for client engagements are governed by a separate signed agreement or statement of work ("SOW"), which takes precedence over these Terms in case of conflict.

3. Account Registration

If our Services require an account, you agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

4. Client Data & Use of AI Products

• If you use CallSync AI, you are responsible for ensuring you have the necessary consent and legal basis to record and process calls with your customers, including compliance with applicable call-recording and telemarketing laws in your jurisdiction.
• You retain ownership of data you submit to us or that is generated through your use of our products, subject to our right to use aggregated, de-identified data to improve our Services.
• We act as a data processor/service provider for client data processed through CitrusIQ, KratosID, and CallSync AI, under the terms of the applicable client agreement.

5. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, or harmful purposes
• Attempt to reverse-engineer, disrupt, or gain unauthorized access to our systems
• Use CallSync AI or other products to make robocalls, telemarketing calls, or communications that violate applicable law (e.g., TCPA in the US, TRAI regulations in India)
• Upload or transmit malicious code

6. Intellectual Property

All content, trademarks, software, and materials on lemonpeak.com and within CitrusIQ, KratosID, and CallSync AI are owned by Lemon Peak or its licensors. Nothing in these Terms grants you rights to our intellectual property except a limited, non-exclusive, non-transferable license to use the Services as intended.

7. Fees & Payment

Fees for client engagements are set out in the applicable SOW or invoice. Late payments may result in suspension of services. All fees are non-refundable unless otherwise agreed in writing.

8. Third-Party Services

Our Services may integrate with third-party platforms (ad networks, CRMs, telephony providers). We are not responsible for the availability or practices of those third parties.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific marketing results, lead volumes, or uptime, except as expressly stated in a signed SOW.

10. Limitation of Liability

To the maximum extent permitted by law, Lemon Peak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services. Our total liability for any claim shall not exceed the fees paid by you to Lemon Peak in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Lemon Peak harmless from claims, damages, and expenses arising from your misuse of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services for violation of these Terms or non-payment. Either party may terminate a client engagement per the terms of the applicable SOW.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India, unless otherwise agreed in a client SOW covering a different jurisdiction (e.g., for US-based clients).

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
